Divorce & Family

Sensitive matters, handled with care and explained in plain language.

Introduction

Divorce is rarely only a legal process. It sits alongside decisions about money, children and a home, and the legal route is often the least of what is being worked out.

We act in uncontested and contested divorce, maintenance for wife and children, and the division of matrimonial assets. Our aim is to explain your options and the likely cost of each one clearly enough that you can make a decision with open eyes, and to keep the process as short as it can honestly be.

What this covers

Divorce is rarely a single question. It is often a property question, a maintenance question, a question about the children, and a question about how to keep a workable relationship with the other parent. We treat the whole picture, not just the petition.

  • Uncontested and joint petition divorce
  • Contested divorce proceedings
  • Maintenance for wife and children
  • Interim and variation of maintenance orders
  • Division of matrimonial property and assets
  • Matrimonial home and property arrangements
  • Consent orders and negotiated settlement
  • Advice on child arrangements and parenting

Uncontested and contested divorce

Where both parties agree on the outcome, a joint petition is the appropriate route. It is faster, less costly, and far less stressful. Where the parties disagree — about the children, maintenance, or the property — the matter proceeds as a contested divorce, and the court decides the disputed issues on the evidence.

Maintenance and children

Maintenance for a wife and children can be claimed during proceedings and, in appropriate cases, after the decree. An interim order can be made early to cover immediate needs while the main issues are still being determined. Orders can be varied later if circumstances genuinely change.

Child arrangements are treated on the basis of the child's best interests, not on the basis of blame. Where children are old enough, their views may also be taken into account. We help you prepare for that conversation constructively rather than reactively.

Dividing the matrimonial assets

Assets acquired during the marriage will generally form the pool from which matrimonial property is divided, and the court looks at the overall fairness of the outcome rather than an automatic half-and-half split. Documentation matters enormously: bank statements, payslips, property documents and business accounts should be gathered early.

Uncontested and contested, and the difference in cost

An uncontested divorce is a matter of documents and a court appointment. A contested one is a trial, and the difference runs from months to years and from five figures to a number with more figures in it. The single most valuable thing either party can do is to agree the terms before positions harden.

Children, and what actually matters

The court decides arrangements for children by looking at the welfare of the child, and it is guided by what has been the child's day-to-day life. That means the arrangement that has been working is the strongest one you have, whatever the paperwork says. Trying to change the status quo at the same time as applying for it tends to work against you.

What to bring

  • Identity documents (NRIC or passport) for both spouses, where available
  • Your marriage certificate
  • Details of children, if any, including birth certificates
  • A summary of assets, liabilities and income for both spouses
