Litigation
Civil disputes and debt recovery, handled with clarity about cost and outcome.
Introduction
Most disputes are not decided in court. They are settled in the space before it, once both sides have a realistic view of what the other can prove and what a judge is likely to award. Litigation is the route when that space closes.
We act in civil claims and defence, contract and commercial disputes, and debt recovery. We will tell you honestly whether your position is strong, what it is likely to cost to pursue, and what a realistic recovery looks like, because a matter that is not worth running is better resolved than won on paper.
What this covers
Most disputes settle before they reach court, and a properly framed letter of demand is often enough. When a matter does have to be litigated, the difference between a well-prepared claim and a poorly prepared one is measured in both money and time. We build the file properly from the start.
- Civil claims and defence
- Contract and commercial disputes
- Letters of demand and pre-action negotiation
- Pleadings, discovery and interlocutory applications
- Court hearings, trials and appeals
- Judgment debt and enforcement
- Recovery of sums owing
Before you issue proceedings
Issuing a claim is not free, and it is not always the right first step. A properly drafted letter of demand identifies the debt, sets out the facts, gives a deadline, and states the consequence of non-payment. In a genuinely straightforward debt it frequently produces payment without any court involvement at all.
Running the claim
Once proceedings are issued, the file has a life of its own. Pleadings must be exchanged on time, documents have to be prepared and disclosed, and the hearing date then governs everything. Clients are told what the next stage is, what it is likely to cost, and what the realistic outcome is — before they have to commit to it.
Recovering money that is owed to you
An unpaid judgment is not the end of the matter — it is a new one. Recovery options include a writ of summons and order for sale, attachment of wages, and bankruptcy proceedings in appropriate cases. We will explain realistically which route is proportionate to the amount owed and the likelihood of success.
Most debts are never taken to court
A properly addressed letter of demand resolves more disputes than anything else a creditor can do. A court claim is expensive, slow, and it hands the other side a deadline to find the money or a defence. The aim of any debt recovery is to avoid it, not to win it.
We send the demand, we give the deadline, and if it is not met we assess honestly whether a claim is worth issuing. Sometimes it is not, and we will say so.
What happens in a civil claim
A claim moves through pleadings, then discovery of documents, then a hearing. Each stage has deadlines attached and missing one is usually more costly than losing the point you were making. We keep you told of what is due and when, because that is the part clients most often lose track of.
What to bring
- Any contract, agreement or correspondence relevant to the dispute
- Records showing the amount owed and when it fell due
- Evidence of the loss, such as invoices, receipts or photographs
- Any earlier demands or replies
